The HSE conceded Prof Tony O'Brien’s claim over his retirement date in a consent decision by the Workplace Relations Commission, dated 8 November 2022.
O'Brien, a Consultant Physician in Palliative Medicine with a joint appointment at Marymount University Hospital/Hospice and the South-Southwest Hospital group, sought recognition of a retirement date of 1 April 2022, saying historic rest days affected the calculation. The parties agreed to adjust the recognised date to 1 April 2022.
The HSE agreed to reconcile his personal pension matters, including alignment to the agreed date, within four weeks. It also apologised for the time taken to resolve the dispute and accepted the relevant terms of his 1998 consultant contract and the application of section 5(d) of its 2012 memo.
