The Workplace Relations Commission found Kelly Rattigan was entitled to a statutory redundancy payment after allowing her appeal against her employer’s decision. The WRC dated its decision 14 September 2022. Rattigan worked as an Accounts Assistant and was laid off at the start of the pandemic. She said she used the RP9 procedure to claim redundancy. NSR Engineering said it had contacted her about returning to work in August or September 2021. The decision found her employment ended on 8 October 2021. Her gross weekly wage was €615, but the statutory calculation was subject to a €600 ceiling. The WRC found the employer had not given the required written notice within seven days of her RP9 notice confirming work would resume within four weeks. It therefore found she was entitled to a payment based on her employment dates and wage; the decision does not state a euro amount.
