The Workplace Relations Commission ordered Picasso Restaurant Ltd to pay former waiter Emiljano Kurtulaj €212 in unpaid holiday pay and €500 for failing to provide a written statement of employment terms. The decision was dated 26 July 2022. Kurtulaj worked as a waiter/runner from January 2020 until September 2021. The restaurant disputed the claims, saying he had not given notice and had received a written statement. The WRC found there was no contract term allowing the restaurant to deduct his accrued holiday pay because he had not given notice. It also preferred his evidence that he had neither signed nor received the contract produced by the restaurant.
