The Workplace Relations Commission found two complaints by Joseph Shanley against Longford County Council not well founded after he did not attend the hearing. The decision was dated 12 June 2023; the merits were not decided.
Shanley said delays to a Staff Officer recruitment competition and his exclusion from its interview stage amounted to penalisation under the Protection of Employees (Fixed-Term Work) Act 2003. The council denied breaching the law and said recruitment schedules changed to meet service needs. It also argued that Shanley was not a fixed-term employee and that one complaint was out of time.
