Waterford restaurant wins disability discrimination case over mask exemption

The Workplace Relations Commission dismissed George-Calin Breban’s disability discrimination complaint against Waterford restaurant Burzza, finding he had not established a prima facie case. The decision was dated 20 June 2022.

Breban said he was discriminated against when he went inside to wash his hands and was asked whether he had a mask and proof of exemption. He said he was exempt but did not tell the restaurant he had a disability or show its staff his medical certificate. The restaurant did not appear at the hearing.

The adjudication officer found that the restaurant could not have discriminated on disability grounds because it had not been informed of Breban’s disability at the time. The complaint failed on its merits.
