Lidl wins disability discrimination case over mask rules at Listowel store

The Workplace Relations Commission found Lidl did not discriminate against Joe Butler on disability grounds after he was asked to wear a face covering at its Listowel store. The decision was dated 15 May 2023.

Butler said he told a security guard he was exempt from wearing a mask, but the guard continued to ask for proof and told him to leave. He said he was refused goods and services. Lidl denied discrimination and said Butler was not denied access to the store or the chance to buy goods.

The officer found Lidl had not been told about Butler’s disability and that there was no evidence he had been treated less favourably because of it. Butler therefore did not establish a case of disability discrimination under the Equal Status Act. The complaint was found not well founded.
