The Workplace Relations Commission ordered The O'hare Group to pay deli assistant Izabela Staneczek €2,491.84 for annual leave accrued during certified sick leave. The decision was dated 17 June 2022. Staneczek said she had not been paid for accrued leave when her employment ended. The employer had argued she accrued no annual leave in 2020 and 2021, but did not attend the hearing. The WRC relied on her uncontested evidence that she had submitted medical certificates during her absence. The award comprised €1,491.84 for accrued leave and €1,000 in additional compensation. The WRC also ordered the employer to familiarise itself with the amended rules allowing leave to carry over for up to 15 months. Staneczek withdrew a duplicate complaint; her separate annual leave complaint was upheld.
