The Workplace Relations Commission ordered R & E Fish to pay fisher Elamir Elamdkhoum €11,540.78 in minimum-wage arrears and awarded him €408 each for unpaid annual leave, public-holiday pay and failure to provide written employment terms. The decision was dated 19 June 2023.
Elamdkhoum said he worked up to 17 hours a day under the Atypical Working Scheme for Fishers and was owed minimum-wage pay. The employer disputed the hours and said he had been paid correctly. The WRC found that the employer could not provide records to contradict his account and directed it to pay the claimed arrears.
The WRC also found that three days of annual leave remained unpaid, that Elamdkhoum had worked on a public holiday, and that he had not received written employment terms. It rejected his notice-pay complaint and found no discrimination on the nationality ground. It had no jurisdiction to hear his Sunday-payment complaint or four other working-time complaints relating to sea fishing. Those jurisdiction findings meant the merits of those complaints were not decided.
