The Workplace Relations Commission awarded Irene Clancy €1,332, equivalent to four weeks’ pay, after finding that Optimum Interiors Ltd. failed to provide her with written terms of employment. The WRC decision was dated 5 October 2022. Clancy worked for the company as a bookkeeper from September 2017 until 18 June 2021. She said she was told there was no money to pay her wages and that she was being let go. The company said it had laid her off because of its financial position and intended to ask her to return when it reopened. The WRC found she had been laid off rather than dismissed, so her unfair dismissal complaint was not well founded. It also found that her redundancy complaint had no basis because no dismissal took place. Her working-time complaint was not well founded because she could choose her hours and take breaks when she chose.
