The Workplace Relations Commission found Sandra O'Halloran was unfairly dismissed by Chadwicks Group Limited and awarded her €12,000 in compensation, plus two weeks’ salary at €560 a week for minimum notice.
The WRC decision, dated 8 November 2022, followed the employer’s concession that the dismissal was unfair. It asked the adjudicator to determine compensation.
O'Halloran said her losses from the dismissal were €18,246. The adjudicator considered her efforts to find work, noting she could not provide evidence of job applications and chose fewer hours in some jobs, but found her evidence that she had made some efforts credible.
The adjudicator said those factors and the circumstances of the dismissal were considered in setting compensation. The minimum notice complaint was also found well founded: with just under four years and five months’ service, O'Halloran was entitled to two weeks’ pay.
