The Workplace Relations Commission found that Yvonne Devlin was not entitled to statutory minimum notice after Woodies DIY Limited dismissed her for gross misconduct. The WRC dated its decision 15 August 2022. Devlin, who had worked for Woodies since 2011, said she was entitled to six weeks’ notice because she had more than 10 years’ service. Woodies argued that her dismissal under its disciplinary procedure meant no notice was due. The adjudicator found that the law allows an employer to end a contract without notice for misconduct, and that an employee dismissed for gross misconduct is not entitled to notice regardless of service length. The WRC found the complaint not well founded.
