The Workplace Relations Commission ordered HSE Mid-West / UL Hospitals Group to discharge 403.90 hours of accrued statutory leave and pay Michael Moore €10,000 compensation. The decision, dated 5 May 2022, also rejected his separate claim that he was underpaid.
Moore said he could not take his full annual leave because there was no cover, and that he was owed accumulated leave. The HSE accepted that leave had accrued but disputed the balance. The adjudication officer considered the SAP record more credible than the manual forms, noting that most forms lacked the required signatures and that Moore’s own records largely corresponded with SAP. The officer calculated 403.90 hours of statutory leave outstanding and found the annual-leave complaint well founded.
The officer also awarded €10,000 compensation, citing the gravity and sustained nature of the infringements. Moore’s Payment of Wages complaint, based on his claim that his duties warranted Band 3 pay rather than Band 4, was not well founded: the officer found he had been paid correctly during his temporary Band 3 appointments. The Act did not provide for job evaluation or regularisation of his post.
