WRC rejects Aishling Tyrrell’s constructive dismissal claim

The Workplace Relations Commission found Aishling Tyrrell was not unfairly dismissed after she resigned from her job with Entertainment Enterprises Group. In a decision dated 12 May 2023, it rejected her constructive dismissal claim. Tyrrell said she was left on lay-off longer than colleagues after objecting to an instruction not to serve customers from the Travelling Community. The group said the lay-off and redeployment decisions reflected the effects of the pandemic and operational needs. The adjudicator found insufficient evidence that her lay-off was punishment for her objection, and accepted the group’s explanations for its staffing decisions.
