The Workplace Relations Commission found that Louth County Council paid Gary Byrne the correct entitlement for a public holiday that fell on a day he did not work. The WRC dated its decision 14 September 2022. Byrne worked a four-day week and was not rostered on Wednesday 17 March 2021. He argued he should receive a paid day in lieu, while the Council said his entitlement was one fifth of his weekly hours, which it had paid. The adjudicator found that the law did not entitle Byrne to a paid day off in those circumstances. The relevant calculation was one fifth of his average weekly pay, and the Council had paid the appropriate rate. The complaint was not well founded.
