The Workplace Relations Commission found three employment complaints by Shauna Cumiskey against Nibeck Limited Adfuels (Daybreak) not well founded. A fourth complaint about annual leave was withdrawn. The decision was dated 17 June 2022. Cumiskey said she was not notified in writing when her hours were reduced, was owed minimum notice pay and was treated less favourably than other part-time staff. The WRC found that written notice was not required because she continued to work more than the 15 hours per week stated in her contract. She was not entitled to minimum notice pay because she had worked for the employer for two months. The part-time work complaint was not well founded because Cumiskey did not provide evidence of a comparable full-time employee. She withdrew the annual leave complaint after acknowledging that she had received her full holiday pay entitlement.
