The Workplace Relations Commission found that Lisa Kelly’s four complaints against Rockabill Seafood Ltd were not well founded. The decision was dated 2 November 2022. Kelly complained about alleged wage deductions, her employment terms, constructive dismissal and family-status discrimination. The WRC said there was no objective evidence to resolve conflicting calculations about wages, and recommended a €515.07 goodwill payment outside its jurisdiction. It found her terms complaint failed because she received her terms within the statutory period and the employer was not legally required to provide a handbook. The constructive dismissal complaint failed because Kelly did not establish that her employer acted so unreasonably that she could not fairly be expected to continue working. Her discrimination complaint failed because the WRC found no evidence she was treated less favourably because she was a single parent.
