The Workplace Relations Commission found that Marius Cristian Gheorghiu was not unfairly dismissed after he resigned from Sienna Star Ltd The Address Citywest Hotel. The decision was dated 26 July 2022. Gheorghiu said reduced wages, unanswered emails and other conduct left him with no choice but to resign. The hotel said its pandemic-era pay reductions were applied across its hotels to keep the business afloat. The WRC found the wage changes reasonable in the circumstances and said Gheorghiu acted unreasonably by resigning without using the grievance procedure. It also found the emails were reasonable and that the refusal of parent’s leave was likely the catalyst for his resignation.
WRC rejects hotel manager’s constructive-dismissal complaint
