WRC rejects Powerscourt Hotel manager’s constructive dismissal complaint

The WRC found Juan Jose Martinez was not unfairly dismissed after he resigned from his Food and Beverage Manager role at Powerscourt Hotel. The decision was dated 10 October 2022. Martinez said the appointment of a new Food and Beverage Director without consultation diminished his role and that the hotel’s grievance process did not resolve his concerns. Sugarloaf Ventures Ltd., trading as Powerscourt Hotel, said the new position was a strategic change that did not alter his responsibilities. The adjudication officer found that Martinez’s role with his team had not changed. Although the hotel could have warned him about the appointment, that failure was not serious enough to justify treating his resignation as constructive dismissal. The officer also found Martinez had not given the hotel enough time to put the grievance investigation’s recommendations into effect before he resigned.
