WRC recommends agency investigate HGV driver’s terms with building-supplies hirer

The WRC recommended that a recruitment agency investigate whether an agency HGV driver’s terms differed from those of directly employed drivers at a building-supplies company. The recommendation was dated 28 July 2022. The worker said direct employees received overtime premiums, meal and mobile-phone allowances, and a Christmas bonus that he did not. The agency said he had provided no evidence of the differences and that the hirer set the terms. The officer said temporary agency worker legislation might be more appropriate, but recommended that the agency open a dialogue with the hirer, check whether there were differences and seek to regularise any imbalance.
