WRC recommends worker accept assurance that investigation records will not be used against him

The WRC recommended that a worker accept an employer’s assurance about records of a complaint and investigation. The recommendation was dated 30 September 2022. The worker wanted confirmation that the records were not on his personnel file and would not be relied on later. The employer said the records were held separately and that it had already confirmed the personnel file contained none. The adjudication officer said the employer could not remove records that were not on the personnel file. She recommended that the separate investigation records not be put on the file or used against the worker, and that written confirmation be sent within 14 days.
