The Workplace Relations Commission directed Getfood Limited Krust Bakery to pay Mauricio Guzman Alonso €399.96 in holiday pay, €1,126.10 in commission arrears and €1,571 in compensation. The decision, dated 14 November 2022, found his complaints about holiday pay and commission well founded, while his notice pay complaint was not well founded. Guzman worked as an area sales manager from 11 January 2021 until he resigned on 29 June 2021. He said he was owed a week’s notice, 2.4 days of annual leave and commission. The company disputed his commission figures, saying sales of €32,421 had been generated, and said he had not worked his final week of notice. The WRC rejected the notice pay complaint because Guzman resigned and did not work his final week. It found he was owed holiday pay for 2.4 days. On commission, the officer said Guzman produced evidence that sales had been omitted from the company’s report, found him credible and noted the company did not provide the requested invoices. The WRC found the failure to provide payslips calculating commission breached the Act.
