WRC rejects bus driver’s constructive dismissal complaint

The Workplace Relations Commission found bus driver Iain Shanahan’s constructive dismissal complaint against Go-ahead Transport Services (Dublin) Limited not well founded. The decision was dated 23 November 2022. Shanahan said accumulated workplace problems, including roster and communication issues, left him with no reasonable option but to resign. The company said he resigned before it had the opportunity to address his grievance. The adjudicator found the company had reasonably proposed discussing the grievance when Shanahan was fit to return. Shanahan resigned while still medically certified absent, before the company could address the issues.
