The Workplace Relations Commission rejected 11 complaints by dog warden Conor Williamson against Dublin City Council, finding no transfer of undertakings had occurred and Williamson was not the Council’s employee. The decision was dated 1 June 2022.
Williamson said his former employer had told him that his employment rights transferred to the Council when it took over dog warden services. The Council said it took over a service contract after the previous provider lost it, with no transfer of staff or assets.
The WRC found that no staff or significant assets transferred and that the dog warden service was run in a fundamentally different way. It concluded that no transfer was established and Williamson was not a Council employee. The complaints included claims about wages, transfer of undertakings, penalisation, working time, dismissal, notice and redundancy.
