The Workplace Relations Commission rejected an anonymised Customer’s complaint that a restaurant Company discriminated against her because of disability, failed to provide reasonable accommodation, harassed her or victimised her. The decision was dated 1 November 2022.

The Customer said staff stopped her from entering because she was not wearing a face covering, despite her exemption lanyard. The Company said it was applying a queue and collection policy during lockdown restrictions.

The adjudicator found the Customer had not provided evidence about her disability to the Company on the day and had not established less favourable treatment or a failure to accommodate. The adjudicator also found she was not refused service, was offered an alternative way to be served, and had not established harassment or victimisation.
