The Workplace Relations Commission upheld Harry Pollard’s Payment of Wages complaint against Sodexo Ireland Limited over a 30% shift allowance. The decision was dated 27 June 2022. No compensation was awarded because the allowance was paid during the six months before he referred the complaint.
Pollard, an electrical technician primarily based in Dundalk, said an agreement made in 2019 entitled him to retain the allowance for on-call availability. Sodexo said it applied only to active on-call hours and had continued to be paid in error. The WRC found wages properly payable up to June 2021 included the allowance.
