WRC directs Sublimity Therapeutics to pay Paula Kearney €8,423.04 in notice pay

The Workplace Relations Commission directed Sublimity Therapeutics Limited (In Liquidation) to pay Paula Kearney €8,423.04 in lieu of three months’ notice. The decision was dated 8 June 2022. Kearney said her contract provided for three months’ notice and that she received no payment in lieu when she was made redundant. The liquidator accepted that she had a three-month contractual notice period and was entitled to payment. The adjudication officer found that the contractual notice period exceeded the statutory minimum and that Kearney was entitled to three months’ salary in lieu. The WRC found the respondent in contravention of section 4(2) of the Minimum Notice & Terms of Employment Act 1973 and directed it to pay the amount.
