The Workplace Relations Commission found Mark Hosey’s dismissal by Mark Johnson Motors unfair because the employer did not follow fair procedures. In a decision dated 9 June 2023, it awarded him €2,640 for not receiving a written statement of employment terms and €2,640 gross in lieu of four weeks’ notice. The decision described both statutory-entitlement awards as non-taxable. Hosey said he had permission to do private repair work using the garage and the employer’s parts account, with reimbursement expected. The respondent said parts for Hosey’s private jobs were charged to its account and left unpaid. The WRC considered dismissal reasonable in the circumstances, but found the process unfair because Hosey was dismissed on the spot without being told the meeting’s purpose or given a disciplinary procedure. It took account of his conduct and made no compensation award for the dismissal. His Payment of Wages Act complaint was withdrawn.
Mark Hosey awarded €2,640 for missing terms and a separate €2,640 for notice
