The Workplace Relations Commission dismissed Barbara Corrigan (Dillon)'s constructive unfair dismissal complaint against the Health Service Executive (Sw Health Board). The decision, dated 5 October 2022, found the complaint was not well founded. Corrigan had worked for more than 19 years as a Senior Clinical Engineer at Naas General Hospital before resigning.
Corrigan said her treatment at work and the employer's handling of her concerns left her with no choice but to resign. The HSE said she chose to resign after not pursuing the grievance procedure recommended to her. The HSE accepted that its initial delay in handling the matter was unacceptable and apologised.
The adjudication officer found that Corrigan had not provided sufficiently detailed allegations and rejected her view that the HR manager's report was inadequate. The officer said she had not used the available procedures, undermining her constructive dismissal claim. Constructive dismissal requires employer conduct serious enough to justify an employee's resignation, assessed objectively.
Her Employment Equality Act complaint was withdrawn at the hearing.
