The Workplace Relations Commission found that An Garda Síochána met its obligation to give Fergus Browne a written statement of his employment terms. Adjudication Officer Catherine Byrne dated the decision 30 November 2021.

Browne worked as a temporary clerical officer at Letterkenny Garda Station from 31 May 2021 until his employment ended on 11 June. He said he had not been told that he was covering for someone on a shorter working year, and that his contract had not been honoured.

An Garda Síochána relied on a contract dated 17 May 2021. The adjudicator found that it set out the main terms and conditions of Browne’s employment and adequately met the statutory requirements for a written statement. She noted that the complaint concerned his dissatisfaction with being dismissed, while the law at issue provided for a written statement of employment terms.

The WRC found that An Garda Síochána had complied with its obligations and decided that Browne’s complaint was not well founded.
