The Workplace Relations Commission found Paul Kinsella’s disability discrimination complaint against Delaneys was not well founded. The decision was dated 1 June 2022.
Kinsella said wearing a mask caused shortness of breath and distress. Delaneys said its shop displayed Covid notices and offered him a face shield, which he refused.
The adjudication officer found Kinsella had not established facts supporting a discrimination claim. The officer noted he had no medical evidence and had not consulted a doctor about his shortness of breath. The complaint failed on its merits.
