The Workplace Relations Commission found Michelle Farrell was constructively dismissed and ordered Ard Ri Marble Mantlepieces Ltd to pay her €27,000. The decision, dated 29 June 2023, said the company’s conduct justified her resignation.
Farrell, a financial controller, said she resigned after the company failed to investigate grievances she had repeatedly raised, including complaints about managers’ treatment of her. The company argued she had not engaged with its grievance process and had agreed her concerns were resolved.
The adjudication officer found Farrell had engaged with successive HR managers and company director Neil Fitzgibbon, but the company had not taken meaningful steps to address her grievances. The WRC concluded that this conduct was unreasonable and justified her resignation.
The WRC selected compensation as the remedy and set the award at €27,000, taking into account what it found were inadequate efforts by Farrell to limit her financial losses. Her annual leave and minimum notice complaints were withdrawn at the hearing.
