The WRC found that Mullingar Specsavers Ltd did not discriminate against or victimise Amanda Dobson after asking her to leave its shop in a dispute over face coverings. The decision was dated 28 September 2021.
Dobson said she had a reasonable excuse not to wear a face covering and alleged disability discrimination and victimisation. The store said staff asked about the face covering to meet public health requirements, and that it asked her to leave after she recorded the exchange and threatened to post it online.
The adjudication officer found the manager had a legal duty to engage with her about the requirement, and that the reason she was asked to leave related to concerns about the recording. The officer found neither discrimination nor victimisation.
