WRC had no jurisdiction over Tomasz Pysz’s HAP discrimination complaints against South Dublin County Council

The Workplace Relations Commission (WRC) found it had no jurisdiction to hear Tomasz Pysz’s complaints against South Dublin County Council, because he had not established that he notified the council as required. The merits were not decided. The decision was dated 8 June 2022.

Pysz alleged discrimination on race and housing assistance grounds in the handling of social housing and Housing Assistance Payment (HAP) applications. He said delays and an income calculation €5 above the threshold contributed to his family leaving their apartment before HAP was approved. The council said social housing and HAP were separate processes and that the applications were handled within the relevant targets.

The officer found there was no evidence that the required written notification had been served. A later email referring to the WRC case did not meet the statutory requirements, and the officer was not satisfied that the council had been notified within two months of the alleged conduct. The WRC therefore found it had no jurisdiction under the Equal Status Act. The decision lists two complaint references but does not give separate findings for each.
