The Workplace Relations Commission upheld Gillian Reilly’s complaint that Wedding List Solutions Limited failed to carry over enhanced redundancy terms when her employment transferred from Brown Thomas. It required the company to pay compensation amounting to five weeks’ pay per year of service. The decision was dated 1 June 2022.

Reilly argued that a collective redundancy agreement providing five weeks’ pay per year of service transferred with her employment in 2008. The company disputed that the enhanced package was part of her employment terms and said she had received statutory redundancy.

The adjudication officer found that documents and the events around the transfer showed there was a collective agreement, and that Reilly had not been told the enhanced package would expire. The officer declared the complaint well founded under the transfer of undertakings rules. Reilly’s separate unfair dismissal complaint was withdrawn at the hearing.
