WRC awards delivery worker €2,000 over working-hours breach

The WRC awarded a delivery worker €2,000 after finding that the company had not proved it complied with working-hours rules. It also awarded €525 for failing to give written notice of a change in employer and €34.75 for an underpayment. The decision was dated 15 July 2022.

The worker said he had worked excessive hours and that the company’s handling of his tax credits affected his reported gross pay. The company said his agreed weekly net pay included subsistence and disputed the hours claim. A payslip showed €490.25 paid against an agreed €525, and the WRC found an underpayment of €34.75.

The WRC found the company had no records to verify hours and had not proved compliance with the 48-hour average weekly limit. It also found that written notice of the employer change had not been proved. The family-status discrimination complaint and two road-transport complaints were not well founded. The WRC had no jurisdiction over the misleading-information and minimum-wage complaints; the merits were not decided.
