The Workplace Relations Commission found three complaints by Olivia Cumiskey against Bothar Company Limited By Guarantee Bothar well founded. In a decision dated 13 August 2021, it awarded her €6,115.38 for 53 days of annual leave due when her employment ended, €1,153.85 for failing to provide an employment statement and €115.38 for the Good Friday annual-leave deduction. Cumiskey, an administrator employed from 2016 until she was made redundant in May 2021, said Good Friday had been a company holiday and that she was owed carried-over leave and time off in lieu. Bothar disputed the leave carryover and argued Good Friday could be taken from her annual leave. The adjudicator relied on the employee handbook's designation of Good Friday as a company holiday, accepted that 53 days of leave were outstanding and found Bothar had failed to provide the required employment statement.
