The Workplace Relations Commission found that Anthony Murphy was not discriminated against when his application to rent a property was unsuccessful. The decision, dated 19 October 2021, rejected his complaint against letting agent Kieran McComiskey Flynn And Associates on housing assistance payment and family status grounds.
Murphy said questions about his income and his pregnant partner’s return to work suggested the agent was concerned he might need HAP. The adjudication officer found that Murphy had neither received nor applied for HAP when he engaged with the agent, and that HAP was not considered in the application process.
On family status, the officer noted that another successful applicant was also a family and that the mother was on maternity leave. The officer found the comparator had equal family status and concluded that the complaint was not well founded.
