The Workplace Relations Commission rejected Grace Buchanan’s Equal Status complaint against Kavanaghs SuperValu after she was refused entry to its Ballybofey store without a face covering. The decision was dated 30 November 2022.
Buchanan said asthma prevented her from wearing a mask and that she told the manager she was exempt. The store said it was enforcing public health rules and had offered her a face guard or to do her shopping for her.
The adjudicator found the manager did not know Buchanan had asthma and that she had been offered a face guard. Buchanan said she could have worn one but would not have felt comfortable. The WRC found the store had not engaged in prohibited conduct.
