The WRC found James Kelly’s complaint against Garda Síochána Ombudsman Commission (Gsoc) about a signed statement of employment terms was not well founded. The decision was dated 5 August 2021. Kelly said he was not given a signed statement when he started a new role with Gsoc on 8 April 2019. The commission argued that his employment as a civil servant with the State began in 2001, so section 3 of the Terms of Employment (Information) Act, 1994 did not apply to his transfer. The adjudicator found the complaint was in time because there was no evidence the contract issued in April 2019 had been signed by the commission. But the decision found that Kelly was a civil servant employed by the State and that section 3 did not apply to the transfer.
