Mary Power was awarded €2,105 after the Workplace Relations Commission found that Vialand Limited Expert Removals failed to provide her with written employment terms. The decision was dated 19 July 2022. Power said the company failed to provide reasonable accommodation for her disability, dismissed her unfairly, paid her less than male and full-time colleagues, and did not give her written terms. The company said she resigned, disputed the alleged pay differences and said it had provided the terms. The WRC found two complaints about written terms well founded. It awarded four weeks’ average remuneration for the failure to provide a written statement of her terms and conditions, and made no separate award for the failure to provide core terms within five working days because the same facts applied. Her working-time complaint was withdrawn. The WRC rejected her disability accommodation complaint, finding she had not established a prima facie case of discrimination; it also found she had resigned, so there was no discriminatory dismissal. Her equal-pay complaint failed because the claim about a €50,000 commission rested on hearsay, and her part-time pay complaint failed for lack of credible direct evidence. A duplicate disability complaint had no separate finding.
