The Workplace Relations Commission found that Michael Tobin was unfairly dismissed by Mikcon Ltd T/A Limerick Packaging and directed the company to pay him €1,730. The decision was dated 16 August 2021. The company said Tobin remained on its books and that it planned disciplinary proceedings over his accident report. Tobin understood the managing director’s words after he completed the report forms to mean he had been dismissed. The adjudicator found that the company had not properly investigated the matter or followed disciplinary procedures. He also found that Tobin contributed significantly to his dismissal through his behaviour and reporting after the accident, and described his evidence about looking for work as unconvincing.
