WRC declines to hear Daniela Krause’s contract complaint against TikTok

The Workplace Relations Commission had no jurisdiction to hear Daniela Krause’s complaint against Tiktok Technology Limited after her job offer was withdrawn before she began work. The WRC dated its decision 4 April 2022. Krause said the offer was withdrawn after she asked questions about her employment contract. The company argued the law did not apply because she had not started employment. The adjudication officer found that Krause was never an employee and therefore had no standing to bring the claim; the merits were not decided.
