The Workplace Relations Commission found Shane Gill’s complaint against the Health Service Executive under the Terms of Employment (Information) Act was not well founded in a decision dated 5 May 2022. The adjudication officer said the long-running temporary arrangement warranted an urgent referral under the Industrial Relations Act. Gill had worked in the HSE’s internal printing facility for almost nine years in an acting manager role after the position was regraded to Grade 7. He and his union sought to have him made permanent at that grade. The HSE said the job, rather than Gill’s temporary status, had been evaluated and the position had to be filled through open competition. The officer found no breach of the information law, while saying the case was more appropriate for an Industrial Relations Act referral.
