The Workplace Relations Commission found that SR Clo Ltd t/a Synchro did not discriminate against Paul McGregor in a complaint about his treatment at a phone shop during mask requirements. The decision was dated 24 June 2022.
McGregor said reduced lung capacity made it difficult for him to wear a face covering. He alleged a staff member told him to put one on or leave the shop. The company said staff followed government and company guidance, and that they could not complete his account request because he was not an authorised account holder. The parties agreed he received a replacement SIM card.
The officer found McGregor was not denied service and had provided no evidence of his disability to the shop manager on the day. The officer also found he had not shown that a comparator received more favourable treatment, so he had not established a prima facie case of discrimination. The complaint was not well founded.
