The WRC awarded Darius Ratinas €2,000 after finding his work fell under the Construction Sector SEO, which sets minimum terms for covered construction workers. The decision was dated 4 January 2023.

Ratinas worked as a small projects supervisor. He argued that his job was mainly hands-on construction work, while Kilcawley Building and Civil Engineering (Sligo) Limited said supervisors were outside the SEO. The adjudication officer found Ratinas spent significant periods doing construction work and that supervisory duties took up a minority of his working time.

The company also argued that the claim was outside the time limit. The officer refused Ratinas’s request to extend the time, but considered the part of the claim within the relevant period. Finding that he was covered by the SEO and had been paid the wrong rate for one week in that period, the officer found the complaint well founded and awarded €2,000 compensation.
