The Workplace Relations Commission found Bartlomiej Wilczynski was unfairly dismissed by Irish Yogurts Limited and awarded him €3,636, equivalent to nine weeks’ salary. The decision was dated 12 July 2022.
The company said it dismissed Wilczynski for gross misconduct, believing he had encouraged staff to refuse a Saturday shift. He denied organising a refusal and said he was dismissed without a fair chance to answer the allegation. The officer found the investigation lacked fair procedures: Wilczynski was not given witness statements or an opportunity to confront his accuser, and the dismissal was disproportionate. The officer also expressed reservations about his efforts to mitigate his loss.
The WRC upheld his minimum-notice complaint and ordered the company to pay €808 for sustained loss. A separate working-time complaint was withdrawn at the hearing.
