The WRC recommended that a psychiatric nurse and a public service agree a process to consider her claim that she should have been treated as its employee before 2022. The decision was dated 21 June 2022.
The worker said she should be recognised as a public-service employee from 1997 or 2000. The public service said she was employed and paid by a public voluntary hospital until she transferred in 2022. The adjudicator found she was integrated into public-service operations, though the hospital paid her wages.
The adjudicator said deciding when her employment began could narrow the parties’ options. He recommended further engagement and a process, potentially involving an independent decision maker, to consider individual claims on their merits. Fast-accrual pension registration was outside the adjudication.
