The Workplace Relations Commission found three complaints by Aer Lingus cargo agent Tomasz Andruszkiewicz were not well founded in a decision dated 13 June 2022. Andruszkiewicz said Aer Lingus unlawfully withheld €1,809.56 and €15,056.04 from his wages. The airline said it repaid the first amount in his final payslip and that the second arose from automatic payments made while he was absent and not entitled to them. The adjudicator found the deductions had been explained and accepted that Andruszkiewicz agreed no unlawful deductions were made when he was deemed fit to work but did not return. His annual leave complaint also failed after he accepted he had been paid for the leave accrued during the period in question. The adjudicator found he had not established facts that could give rise to a presumption of discrimination, and found he was neither discriminated against nor victimised.
