The Workplace Relations Commission awarded Nicholas Power €1,500 after finding his dismissal by Shane Comerford Ashcraft Construction unfair. The decision was dated 21 September 2021. Power’s redundancy payment complaint was withdrawn, while his minimum notice complaint was not well founded. The adjudicator preferred the employer’s account that Power had failed to carry out assigned tasks, but found there were no formal dismissal procedures, written warnings or opportunity for Power to defend himself or appeal. The adjudicator also found Power had contributed significantly to his termination. He found new work three months later at a higher salary and had met his obligation to seek work.
