Clare County Council did not unfairly dismiss John Morgan

Clare County Council did not unfairly dismiss John Morgan when his fixed-term contract expired, a WRC adjudication officer found in a decision dated 7 September 2021. The officer found the signed contract excluded an unfair dismissal claim when its fixed term expired, and that the dismissal consisted only of that expiry.

A separate complaint under the Protection of Employees (Fixed-Term Work) Act was brought outside the time limit, and the merits were not decided. Morgan argued the council renewed his contract without written grounds and dismissed him without offering an appeal. The officer also found that Morgan’s two years of fixed-term employment did not entitle him to a contract of indefinite duration.
